INTRODUCTION
The Customs Proclamation that gives the sole mandate of approving duty-free privilege to the Ministry of Finance is legislated by the Ethiopian Parliament. Until the promulgation of this law, duty-free privileges were being issued by 24 government institutions including regional governments.
As per Article 129 (1) of the enclosed Proclamation all requests for duty-free import and export of goods by investors will be granted only by the Ministry of Finance. Article 129 (3) explicitly states that “the power granted by law to other government bodies to allow duty free rights is hereby transferred to the Ministry of Finance” and Article 129 (6) mandates the Council of Ministers to “issue Regulation on the conditions in which duty free rights are granted and implemented”.
This Proclamation has also included other provisions that enables companies to clear customs at their premises, enables the tracking of trucks with tracking decide and introduces post-evaluation audit system.
The Proclamation is approved by the Ethiopian Parliament on July 31st 2019 as Proclamation No. 1160/2019 but it is published on the Federal Negarit Gazettee and came into effect as of September 30th 2019.
